I see that you have lived a nice and sheltered life... Good for you...

Anyway, how else do you explain the current situation? If the ownership and re-loaning was so clear-cut, would we have this problem?
If this was actually the situation, presumably it would be something along the lines of fixing a way to avoid suddenly finding ourselves with a bigger salary cost than planned... Or something... Wtf do I know about sports management?

There is no mystery to weemac's position. He is contracted to us until the end of the coming season. He is due back under his loan agreement on Jan 1 an can only play for his Japanese club until then. Was offered a big two year contract by Wellington and asked the club for a release promising to come back at the end of the two years. Mariners said no, reminded him that he was allowed to go to Japan for a year to make big money and was told "we will see you on Jan 1". Hopefully the FFA will show some b#### and back the valid contract held by the Mariners.

f**k the Nix. f**k the fact that contracts seem to mean nothing for the Mariners.
f**k the FFA, show some balls and back your own contract system. The release clause should be much much harder to implement, and whats worse is that the mariners as a team need to make efforts toward reversing the impression players currently have, and that is, squeal hard enough for something better and you will be allowed to leave....

I hope we shut this down quick, I would love to think that Glinch is not going to go sour because of it, but if he does, tough titties buddy

From a legal perspective he no longer has a contract. Maybe from a moral perspective but not legally.

Go to www.asic.gov.au and do a company search and you will see why. 10 minutes of free searching and it all folds out.

All thats left if for the Mariners to try and legally challenge their mistake and see if they can stop him. Don't like their chances.

Time for A league to go professional & insert transfer fees. If it was legal to transfer between Al eague clubs everyone knows CCM would seell - just want the money for him. They would have sold him in a heart beat & everyone happy. We want to own him so we can sell him somewhere where we get paid.

Was a stupid idea to loan him out for nothing in the beginning. He surely owes us for letting him go & should be pissed at Arnie not us.

Weemac is now officially money hungry. That means the end of his CCM relationship no matter what. Not saying it's wrong at his age but he just needs to be cut free so eddie can smash him in a tackle.

Is this just the best ploy in the world to get people to go to NSO or Brookie. Come & have a scream at once fan favourite & now SFC's biggest rival for being hated upon by CCM.

On the 1st of jan we should sell him to Thailand or some shithouse league where he will get paid.

He's trying everything to go so time to say we stuffed up & goodbye. We only want players who want to be here

Not sure how this is the fault of current management . I hope FFA step in.

My guess is we let go Flores because we assumed he would come back..

That's not a report, that's a forumite posting it. It hasn't been reported by any media outlet. For all we know, Ryan's Rovers just Bilo under a different name. A couple of forumites on different forums under different names and suddenly it looks like a story, but nobody from the club has confirmed it and nobody from FFA has confirmed it and nobody in a media outlet is reporting it.

On the contrary - we know the following because it's been reported by sources more reputable than some internet hero:
  • McGlinchey went on loan to Vegalta Sendai (meaning he was permitted to train and play with the Japanese club) until December 31
    • The loan *appears* to have come to an end, but there's no hard confirmation
  • McGlinchey now wants to play for Wellington and has been in discussion with them and wants to train with them as of today, but the Mariners are asserting their contractual rights
It sounds like he wants to seed doubt about the status of his contract, presumably to get us to roll over and grant him a release. The consistent line coming from the above-mentioned internet heroes is that the players' contracts became void at some point owing to the club changing ownership and players had to re-sign, but that's not been reported by *any* media source, just a bunch of people gleefully (and mostly anonymously) reporting tales of woe.

It also seems *extremely* unlikely to be true: the club continues to be the club (no matter who the owners are), and the club is the party to the contracts, not the owner (whoever that is from time to time).

The club still exists - the company here was established in 2004 and continues to exist, no matter that on 1/10/2013 there is listed "Change to Company Details Change Officeholder Name Or (484A1) Address ()" or that on 10/1/2014 there was "Notification By Officeholder of Resignation or Retirement (370)".

The company remains - there's nothing in an ownership change by itself that makes the company no longer retain the same assets, liabilities, rights and obligations. That would include player contracts and a licence to participate in the A-League.

So having dealt with that, he can't actually transfer for a fee, so it's a release or nothing. He can play at Vegalta Sendai or at Central Coast Mariners or he can sit on his arse and wait it out.

A complicating factor is that it's unlikely that the club planned for him to come back to us, so we probably have neither a squad spot nor cap space available (perhaps this is the loophole they're trying to access).

But that's for the club to manage, not for him to engineer an outcome in his favour. The club might work another solution (e.g. finding another home for a different player to open up the squad and cap space).

Breaking his contract unilaterally (by going and training with Wellington) could wind up expensive for him and Wellington, and frankly if the Mariners hold a valid contract that he's spitting on, I hope it does.

No not pleased, just shows the incompetence of management. On a day when Melbourne Victory are signing players from Barcelona we don't even know who is contracted to us. I want this shit sorted so we can stop going from one back office stuff up to the next and get a quality football team to follow.

Everything you said above is true from a football perspective but not from a legal perspective. when a new owner comes in they normally takeover the old club and continue to run it. That did not happen in this case. The new owner started a new company to protect from the debts of the old company and transitioned the licence over to the new company. He got all the players to sign new contracts with the new company, but they forgot one who was out on loan somewhere. Thus he doesn't have a contract with the company that now runs the franchise.
What's the name of the other company?

Wee Mac has been a great player for us but as usual feel we have once again been shafted. I guess that both the club and Wee Mac were expecting Arnie to stay in Japan and sign Wee Mac once his contract was over. Not sure if the Nix just offered more money, he wanted to be closer to the NZ national team, or was unsure of his future at the Mariners (especially while Bernie looked like staying). Not sure what i want to happen here apart from not wanting McGlinchley back now, looks like he has his heart set on a move and we don't need him here half hearted. Saying that, don't dislike the guy and not sure i want him out of action till Jan. The FFA need to step in and clear this up, a contract should be a contract and it seems there is alot of confusion. Not having much luck with loans at the moment with Danny leaving last season, Bernie not extending and now Wee Mac not fulfilling his contract (unless proved it had been broken).
