I'm also of the opinion that he can get f**ked. I hope he gets banned by the AFC like Bresc did. Make an example of him. Force the FFA to move on the stupid no transfers between clubs rule.

You have got to laugh. This is when he makes himself look silly. I would respect him more if he just came out and said something like " I had three great years at the Mariners and wanted a change and looked forward to working with Ernie Merrick"

I might not like that but at least its professional.

Unless there has been the stuff up of all time I think MC will be back with us ... the real question is do we take him from the start of the season or 01/01/15 ..

My reasoning is this and I stated it before but its worth stating again... assume MC had been hurt in Japan and could never play again ... would the Mariners have been told to pay his wages under the contract .. my guess is yes ... meaning the contract must be valid... so how does an offer then make the contract invalid ..

I suspect a continued role in the NZ national team and subsequent paypacket has a lot to do with this

Just a clarification: transfers between clubs of any code in Oz are banned due to the tutty case in rl many moons ago. Transfer fees were ruled a restraint of trade and hence illegal. They are not coming back until the TPA is amended, which would be sometime bbetween a long time and never.

This does not affect transfers involving a local club and an overseas club.

The Tutty case pre-dated the TPA (High Court ruling was in 1971, TPA passed under Whitlam in 1974 and is now known as the Competition and Consumer Act 2010).

The Tutty case was more similar to the Bosman case - a player when off-contract can no longer be restricted from selling their services to the highest bidder.

However, there would be nothing in that ruling that would prevent a player or a club from insisting that a contract be fulfilled that they have signed unless certain conditions apply (failure on the part of one or other party to adhere to certain terms or mutual termination). Transfer fees are just a form of compensation to a club when a player leaves *before* their contract is complete. A player may also pay the compensation personally (i.e. "buying themselves out" of the contract).

It makes an argument against transfer fees not because they are illegal but because they do not assist with maintaining competitive balance.

Begs the question though, why have there not been any transfer fees between local clubs anytime in the recent past (of any code that I am aware).

We'd have no financial dramas if we could transfer to other a league clubs. Can't say the same for the rest of them as we would have probably fleeced them ;)

I don't think we have the quality anymore for a top 4 position

Tis not the Mariners way to look strong at the start of a season. We find good players from no-where, we over perform, we have high squad turn over when we do have good players, and we still punch above our weight.

I am concerned, I don't think we'll win any trophies… but I also don't think it will be as doom and gloom as some predicting.

We have lost our three best players...WeeJudas, Bernie and Flores.

We were lucky to even make the finals last season and played horrible for 70% of the season until ACL came around.

BUT....we have a couple of top Juniors to break through his year.

And Apparently we are going to bring in some quality AND we are the Mariners and we revel in doing it the hard way so don't write us off just yet.

I'm keen as for next season but I'm scared too......BUT Mossy and his young charges could really shake the competition and keep us all happy.

. i think you had previously answered your own question ... and nobody else seems to have really taken your ideas on board. i think there are a number of 'issues' that are bringing this whole thing undone and why nothing is as clear cut as we would like it to be ... or in fact as clear cut as a contract should be

. i feel really uneasy about how all of this has been handled, or mis-handled. there have been many contributing factors and imo they can all be placed at the feet of fund-raising or penny-pinching – a couple to consider:
  • having our long-term CEO replaced by the former owner on an interim basis
  • removing Lawrie from his role as Football Director and this role incorporated into Arnie’s responsibilities
  • is there any wonder we either don’t know or have been screwed over by the contractual situation?
. once Flores was injured (Mikey hadn’t even left) … the Club should have pulled the pin. but that would have required the deal was set up correctly in the first place and that the Club had the balls and/or foresight to pass on the (reportedly small) transfer/loan fee - for the overall benefit to the Club ... perhaps all of this could have been avoided ... perhaps Mikey would have been so relieved we saved him from a debacle he could have led us to another GF win

. i suspect that the promise of a large on-selling payment played a big part in the decision to let him go anyway ... another dream unrealised

. i supect that once the loan deal came to an end (regardless of the circumstances that led to that ... or at least to consider them as a complicating side-story for a moment) that we once more became responsible for mikey's wages

. if the mariners didn't pay then they may have been the first to breach the contract - new, existing or pending a transfer of ownership formality. if we did pay maybe we would have breached the salary cap rules ... which in reality we wouldn't have been able to afford anyway

. no wonder this is going to mediation ... everybody's position is uncertain, everybody is partly to blame. the club can't afford the legal costs, can't afford the salary and probably doesn't have the cap or squad space for the little fella to come back ... why else would they be insisting on the ridiculousness of the 1st Jan. if we can accommodate him then, we can accommodate him now (nobody else's contract will be ending between now and then to create space)

. mediation is a cost saving and face saving measure. forget, for a moment, that mikey wants (and needs money) ... i can't help but think the club has screwed themselves over through contract mis-management and the excited promise of on-selling an expensive player. unfortunately, in the process, the fans have been double-screwed ... again

I'm curious - several people have thoughts that having Weemac back now could push us over the cap. is this known or guessed at because of the Jan 1 thing? it's just if we're looking for 3 new players doesn't that suggest there's cap space available?

It is guess work by me; I could never know what players are being paid but given that we have to meet salary cap rules during the season we would have filled the void left by WeeMac going; I doubt the Flores money is available as we pretty much filled our squad in January last year. And all the indications have been of Moss proceeding without including WeeMac. We may be looking for two or three players but one is a back up goalkeeper; I am not expecting ground shaking signings for the others.
