To be honest Mick, I'm all for someone having the will to force the FFA to explain why they have a habit of shifting the goal posts like changing socks, poor transparency and refusal to be answerable for their actions. Be it Palmer or someone else with the clout to put the cat amongst the pigeons. We tend to forget the past too easily,  the recommendations of the Crawford report and what led to them.
If fighting fire with fire assists in a long term culture change, I'm backing it.

Whilst I think the rules (as exploited by MV/CCM) are stupid, both clubs abided by them.

If GCU/NQF structure a deal that falls within the rules no problem.

Would involved Folwers contract being torn up and he has a year to go whereas Nik only had a few months.

In this case, the rule isn't the rule as it doesn't exist to cover this particular scenario. No rules were broken by either club. But that's not in contention. The spirit of the rules 'are seen' to be leaned on quite a deal, along with a lack of explanation from the FFA. Because this scenario has not been foreseen and therefore not clear in the regulations, they now have to clarify the rules to include or exclude the signing of players from others aleague clubs during the current season and outside a transfer window and under similar circumstance as the "special circumstance" permitted in the Mrjda signing. First of all, they should clarify just what those 'special circumstances' are in governing their decision to allow the transfer. As yet there has been no effort made to do that, nor is there any information that they intend to close the loophole or open a Pandora's box. The rules at present don't state is is allowable nor do they state it isn't, however, a common opinion is it's not in the spirit of the rules.

IMO, for the FFA to be seen to be not moving the goal posts is as important as the reality.
And I still stick by my opinion that the FFA must be seen to be transparent and if that isn't forthcoming and it takes an individual with clout to force transparency, then so be it.

Mrdja was able to Melbourne on a free transfer because he was in the last 6 months of his contract (like Galekovic, Downey and McBreen before him).

Fowler has 17 months left on his contract with Fury and can't leave for another HAL club (loan deals and transfer fees aren't allowed between HAL clubs) unless his contract is terminated first.

Not actually the case... a free transfer move would have meant he couldn't go until his current contract had expired (either March or June... most likely June).  He was actually released then signed as a free agent by Melbourne.  On the same day (apparently) he signed a contract with you guys that doesn't have a start date until August (or so).

The same could be done for Fowler, if NQ weren't terrified he'd sign somewhere else after being 'released'.

Barlow bewildered by Mrdja machinations
Nik Mrdja . . . At the centre of controversy.




SIMMERING tensions between Sydney FC and Melbourne Victory have boiled over after Sky Blues vice-chairman Scott Barlow launched a stinging attack on the reigning champions over their controversial ploy to temporarily acquire Nik Mrdja on the eve of the finals.

Both Barlow and majority owner David Traktovenko generally shy away from the public eye but the former rebuked Sydney's bitter rivals and also the FFA after seeing it consent to the deal, freeing Mrdja to play for Melbourne for the rest of the season.

That means the former Socceroos striker will front for Sunday's blockbuster between the two clubs at Sydney Football Stadium, his second match for the Victory after last weekend's 2-0 win over North Queensland.

While the footballing community is still coming to grips with how Melbourne secured the forward from Central Coast - the club he will re-join in August - outside of the transfer window, Barlow was furious at both clubs and the governing body.

''This Sunday's game is the biggest game of the year for us,'' he said. ''In fact it is one of the biggest games in Sydney FC's history. Not only will the winner become premiers but they will also secure a highly valued position in the 2011 Asian Champions League. We understand that Mrdja's contract with Central Coast Mariners ran until 31 March, 2010, but it was terminated early to free him up to accept Melbourne's offer and at the same time he agreed to a new deal to play with the Mariners next season.

''The early termination of his contract clearly had nothing to do with the player leaving the club. It was purposely done in order to put the player in a position to temporarily join a new club, creating what is effectively a loan deal.''

For Mrdja to move to Melbourne on a loan deal, it would have needed to have taken place before the January 31 close of the transfer window. Barlow said Sydney would not stoop to such tactics.

''Approval of these kinds of player movements at such a critical stage of the season seriously undermines the credibility of the A-League,'' he said. ''We found ourselves in a similar situation a few weeks ago and could have targeted star players from A-League teams that would not qualify for the finals. We chose not to go down this path.''

The sentiments seem to have struck a chord with the FFA, which last night admitted it would investigate changing the rules.

''We have listened to the clubs and other stakeholders over this particular case and agree with the argument that its use in this case is not in the spirit of the original intention of the rule,'' A-League chief executive Archie Fraser said.
The FFA accepted the deal as it was lodged before last Thursday's short-term deal deadline and because of the injury crisis that cruelled Melbourne stars Archie Thompson and Robbie Kruse and a host of youth team strikers.
